AudioControl Mobile App Privacy Policy

This Privacy Policy describes how AudioControl, a brand of AAMP of Florida, Inc. ("we", "us", or "our") collects, uses, and discloses information when you use the following mobile applications (each, an "App", and collectively the "Apps"):

  • DM Control (Android package com.stinger.dmcontrol)
  • DM Smart DSP (Android package com.stinger.dmsmartdsp)
  • DM-RTA (Android package com.stinger.dmrta)

This Privacy Policy applies only to the Apps listed above. Your use of audiocontrol.com, including purchases, accounts, and marketing communications, is governed separately by our website Privacy Policy at https://audiocontrol.com/policies/privacy-policy.

Please read this Privacy Policy carefully. By downloading or using any of the Apps, you agree to the collection, use, and disclosure of your information as described here. If you do not agree, please do not use the Apps.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on this page, update the "Last updated" date, and take any other steps required by applicable law.

How the Apps Work

The Apps are companion tools for AudioControl hardware. They connect to a signal processor, amplifier, or test and measurement device over a wireless or wired connection so that you can read and adjust settings, run measurements, and store or recall configuration presets.

Configuration data, tuning presets, and measurement results that you create in an App are stored on your mobile device and on the connected hardware. We do not collect or store that data on our servers.

What Personal Information We Collect

When we use the term "personal information", we are referring to information that identifies, relates to, describes, or can be associated with you. The information we collect varies depending on which App you use and how you interact with it.

Information We Collect Directly from You

  • Project and preset details including the names, labels, and notes you type into an App to identify a vehicle, tune, or measurement. This information is stored on your device and is not transmitted to us.
  • Customer support information including your name, email address, and the contents of your message if you contact us for help with an App.

Some features may require you to provide this information. You may elect not to provide it, but doing so may prevent you from using those features.

Information We Collect about Your Usage

The Apps use third party crash reporting and analytics software development kits, which automatically collect information about your interaction with the App ("Usage Data"). Usage Data may include your device model, operating system version, App version, language and region settings, mobile network and connection type, crash and error logs, diagnostic and performance data, and information about which App features you use and for how long. This information is associated with a randomly generated app or device identifier rather than with your name.

Device Permissions

The Apps request the following permissions from your mobile operating system. Granting a permission does not give us access to your information. The permissions are used only for the functions described below, and you can revoke any of them at any time in your device settings.

  • Bluetooth and nearby devices. Used to discover, pair with, and communicate with your AudioControl hardware. We do not use this permission to collect information about other devices around you, and we do not use it to determine your location.
  • Microphone. Where an App provides acoustic measurement functionality, such as a real time analyzer, it uses your device's microphone to capture audio for that measurement. Audio captured for measurement is processed on your device and is not recorded, stored by us, or transmitted to us.

Information We Obtain from Third Parties

We may receive information about you from vendors and service providers who collect information on our behalf, including our crash reporting and analytics providers and the app distribution platform through which you obtained the App. Any information we obtain from third parties will be treated in accordance with this Privacy Policy.

How We Use Your Personal Information

  • Providing the Apps. We use your information to operate the Apps and enable them to connect to, configure, and measure your AudioControl hardware.
  • Diagnostics and service improvement. We use Usage Data to identify and fix crashes, defects, and connectivity problems, to understand which features are used, and to improve the Apps and develop new features. This is in our legitimate interest in providing effective and reliable software.
  • Communicating with you. We use the information you send us to respond to your support requests and to be responsive to you.
  • Security and fraud prevention. We use your information to detect, investigate, or take action regarding possible fraudulent, illegal, or malicious activity.
  • Legal compliance. We use your information to comply with applicable legal obligations, to enforce any applicable terms of service, and to protect or defend our rights and the rights of our users or others.

How We Disclose Personal Information

In certain circumstances, we may disclose your information to third parties, including:

  • With vendors or other third parties who perform services on our behalf, such as crash reporting, analytics, cloud storage, IT management, and customer support. These vendors use the information only to provide services to us.
  • With our affiliates or otherwise within our corporate group, in our legitimate interests to run a successful business.
  • When you direct, request, or otherwise consent to disclosure of certain information to a third party.
  • In connection with a business transaction such as a merger or bankruptcy, to comply with any applicable legal obligation (including responding to subpoenas, search warrants, and similar requests), to enforce any applicable terms of service, and to protect or defend our rights and the rights of our users or others.

Retention and Deletion of Your Information

Configuration data, presets, and measurement files that you create in an App are stored on your device and on your connected hardware. You can delete them at any time by deleting the file within the App, clearing the App's data in your device settings, or uninstalling the App. Uninstalling an App does not remove settings you have written to the hardware itself.

Usage Data collected by our crash reporting and analytics providers is retained for the standard retention period applied by those providers and is then deleted or retained only in aggregated form that cannot be associated with you or your device.

How long we retain other information depends on factors such as whether we need it to provide the Apps, respond to your support request, comply with legal obligations, resolve disputes, or enforce other applicable contracts and policies.

Security

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee perfect security. In addition, any information you send to us may not be secure while in transit. We recommend that you do not use insecure channels to communicate sensitive or confidential information to us.

Children's Data

The Apps are not intended to be used by children, and we do not knowingly collect any personal information about children. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the details below to request that it be deleted.

Your Rights

  • Restriction of Processing. You may have the right to ask us to stop or restrict our processing of personal information.

  • Appeal. You may have a right to appeal our decision if we decline to process your request. You can do so by replying directly to our denial.

International Users

Please note that we may transfer, store, and process your personal information outside the country you live in, including in the United States. Your personal information may also be processed by staff, third party service providers, and partners in those countries.

If we transfer your personal information out of Europe, we will rely on recognized transfer mechanisms such as the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the United Kingdom, as relevant, unless the transfer is to a country that has been determined to provide an adequate level of protection.
